The historical revisionists are very fond of ignoring the little fact that the self-proclaimed dictator of Mexico trashed both the Mexican constitution and the agreement that the colony of Texas had made with Spain.
Based on Santa Ana's later actions, I'd say Austin was lucky that he was only imprisoned, and not simply put before a firing squad.
